Right of Withdrawal

You have the right to withdraw from this contract within thirty days without giving any reason. The withdrawal period is thirty days from the day the contract is concluded (for services and digital content) or from the day on which you or a third party named by you takes possession of the goods (for the purchase of goods). To exercise your right of withdrawal, you must inform us (ELFA UG (haftungsbeschraenkt), Pullach im Isartal, Germany, email: kontakt@getvq1.com) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but it is not mandatory. To meet the withdrawal deadline, it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (with the exception of the additional costs arising from your choosing a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we receive notification of your withdrawal from this contract. For this reimbursement, we use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this reimbursement. In the case of contracts for goods, we may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earliest. You shall send back the goods or hand them over to us (ELFA UG (haftungsbeschraenkt), Orleansstrasse 21, 81667 Munich, Germany) without undue delay and in any event not later than thirty days from the day on which you communicate your withdrawal from this contract to us. The statutory period for returning the goods is fourteen days; we voluntarily extend it to thirty days. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods. In the case of contracts for services where performance begins before the end of the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated your withdrawal.

No Right of Withdrawal for the Individually Mixed Supplementary Feed

There is no right of withdrawal for contracts for the supply of goods that are not prefabricated and for whose production an individual selection or specification by the consumer is decisive, or which are clearly tailored to personal requirements (Sec. 312g(2) no. 1 BGB). The supplementary feed mixed specifically for your horse on the basis of your individual analysis is such a good; there is therefore no right of withdrawal for this product. We point this out to you clearly before you place your order.

Early Expiry of the Right of Withdrawal for Digital Content

For a contract on the supply of digital content not on a tangible medium (e.g. nutrition and requirement analyses), the right of withdrawal expires pursuant to Sec. 356(5) of the German Civil Code (BGB) if you have expressly consented to us beginning performance of the contract before the withdrawal period expires and you have confirmed your awareness that, by giving your consent, you lose your right of withdrawal upon commencement of performance of the contract.

Voluntary 30-Day Satisfaction Guarantee (not part of the statutory policy)

Irrespective of the statutory right of withdrawal set out above, we grant a voluntary 30-day satisfaction guarantee (see the GTC, section “Voluntary 30-day satisfaction guarantee”). This guarantee applies alongside your statutory rights, does not restrict them, and expires as soon as you download the digital analysis content. The statutory rights under this withdrawal policy remain unaffected.
